By clicking “I agree with the terms and conditions" on the purchase page, you enter into the following agreement as a client of Tracie Miles Author Coaching. There is a no refund policy, further explained at the bottom of this page.
Purpose of this Agreement
Client agrees to hire Tracie Miles to provide one-on-one coaching services of their choice related to the Client’s writing goals, or group coaching if a program is currently active. Upon purchase of services, Tracie agrees to provide such services according to the terms of this Agreement and will deliver all promises made to the author about the coaching services.
Terms
Services:
Once a client has selected and paid for the coaching services of their choice, Tracie will provide the Client with coaching and accompanying resources in accordance with what is promised in the description of the coaching service or package on Tracie Miles' website.
Delivery of Services / Scheduling:
Upon purchase of one on one coaching services or packages, an email will be sent to the Client from Tracie Miles Author Coaching within 24 hours of purchase (if not immediately) which will provide a link to a private Google Client Folder with important documents and resources, as well as the link to sign up for coaching one-on-one meetings.
Upon purchase of group coaching services, Client will receive an email containing all the information needed to participate in the group coaching program.
Coaching Services Costs and Fees:
The cost of each coaching service or package is clearly stated on the website. No discounts or requests for scholarships or free services are available. All costs and associated fees must be paid in full prior to any services being rendered. Any digital, downloadable resources or tools purchased will be sent in email immediately upon completion of payment and cannot be refunded.
Cancellation, Rescheduling and No-Shows:
If Client needs to reschedule a 1:1 session, Client shall provide effective notice to Tracie Miles via email within one business day prior to the session, or reschedule the session via her Calendly link. If client does not show up to the ZOOM call within 10 minutes of a scheduled coaching session,Tracie Miles will not be obligated to offer any refund for unused or missed coaching sessions or reschedule the coaching session. If Tracie needs to reschedule a session due to an unexpected personal or work conflict, she will also provide at least one day business notice to the Client.
If a group coaching Client is unable to attend a session, there will be no makeup session with the group or with the client individually. Replays will be available in the program's dedicated Facebook group.
Intellectual Property and Privacy:
Every writer/author will maintain all Copyright and ownership rights of the content they create. Content can be used in any form in print or online at the discretion of the Client.
Any resources, worksheets, homework assignments, writing prompts, etc., which are created by Tracie Miles and provided to the client remains the Copyrighted property of Tracie Miles Author Coaching and cannot be shared, reproduced, revised or redistributed.
Creators of content, whether Client or Tracie Miles, is protected pursuant to the federal copyright law (Title 17, Chapter 2, Section 201-02 of the United States Code), whether registered or unregistered.
Refunds:
By agreeing to these terms and conditions, Client understands that no refunds will be given for any reason at any time, and in pursuant to agreeing to the remainder of terms in this agreement. In addition, since purchased downloadable resources are sent via email immediately upon receipt of funds, and cannot be retrieved form Client, refunds are not an option for any purchased products.
Inability to Provide Services Agreement
In the event any of the below circumstances occur:

Tracie Miles cannot perform the agreed upon obligations and provide the services paid for by the Client due to personal life conflicts

Tracie Miles chooses not to perform the agreed upon obligations and provide the services paid for by the Client due to concerns with the written content a Client wishes to have reviewed or be coached on

Tracie Miles feels inappropriate behavior is taking place via email, phone or video communications

Tracie Miles feels the client is engaging in threats, harassment, unprofessional language or behavior
Then, Tracie Miles agrees to provide to the Client:

Immediate notice via email that the contract for coaching is being terminated immediately

Provide immediate refund of all remaining monies paid, excluding the costs of any services already rendered.

Excuse Client of any further performance and/or payment obligations.
Confidentiality & Privacy:
Tracie Miles will hold confidential and private any information shared verbally as well as any written content shared by the Client. At times, and when noted on the website page, video calls will be recorded and the links will only be shared with the Client. Tracie Miles will not share any information communicated to her with anyone unless there is reason to believe that an individual is going to harm themselves or others. Since the internet is not 100% secure, Tracie Miles cannot guarantee the security of any content or data transmitted through communications with Client. Client agrees to assume all risks associated with sending communications and content over the internet and agrees to relieve and hold harmless Tracie Miles as a result of any loss, misuse or theft of personal written content.
